1. Agreement

These terms and conditions govern the provision of painting and decorating services by Painter Girl & Co ("the Company") to the client ("the Client"). By accepting a quote or engaging our services, the Client agrees to be bound by these terms.

2. Quotations

All quotations are provided in New Zealand Dollars (NZD) and are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on the scope of work described at the time of inspection and may be subject to change if additional work is required or site conditions differ from those assessed.

The Company reserves the right to adjust pricing if the scope of work changes after the quote has been accepted.

3. Acceptance & Scheduling

Work will be scheduled upon written or verbal acceptance of the quotation. We will make every effort to commence and complete work within the agreed timeframe, however start dates and completion dates may be affected by weather conditions, material availability or other factors beyond our control.

4. Payment Terms

Payment terms will be outlined on each individual quotation or invoice. For larger projects, progress payments may be required at agreed stages of the work. All invoices are due within 7 days of the invoice date unless otherwise agreed in writing.

The Company reserves the right to charge interest on overdue accounts at the rate of 2% per month.

5. Scope of Work

The Company will carry out the work as described in the accepted quotation. Any additional work requested by the Client during the project will be quoted separately and must be agreed upon before being undertaken.

6. Surface Preparation

The Company will undertake reasonable surface preparation as included in the quotation. If unexpected surface conditions are discovered during preparation (such as rotten timber, plaster damage or lead-based paint), the Company will notify the Client and provide a separate quote for any additional remedial work required.

7. Materials & Colours

The Company uses quality paint products from reputable manufacturers. The Client is responsible for final approval of all paint colours before application. Minor colour variations between sample swatches and the finished result may occur due to differences in lighting, surface texture and batch variations. The Company is not liable for colour discrepancies once an approved colour has been applied.

8. Access & Site Conditions

The Client is responsible for providing safe and reasonable access to all areas to be painted. This includes clearing furniture, personal items and obstructions from work areas prior to the commencement of work. The Company will take reasonable care to protect floors, fixtures and landscaping but will not be held liable for incidental damage to items left in the work area.

9. Weather Conditions

Exterior painting work is subject to suitable weather conditions. The Company will not paint exterior surfaces in rain, extreme humidity or temperatures outside the paint manufacturer's recommended application range. Delays due to weather do not constitute a breach of contract.

10. Warranty

The Company provides a workmanship warranty on all completed projects. The warranty period will be specified in the quotation. This warranty covers defects in application such as peeling, flaking or blistering caused by our workmanship. The warranty does not cover damage caused by impact, structural movement, moisture ingress, surface contamination or normal wear and tear.

11. Liability

The Company carries public liability insurance. Our total liability for any claim arising from our services is limited to the value of the contract. The Company is not liable for any consequential, indirect or incidental losses.

12. Cancellation

Either party may cancel the agreement by providing written notice. If the Client cancels after work has commenced, the Client will be liable for payment of all work completed to date plus any materials purchased specifically for the project.

13. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through direct negotiation in the first instance. If a resolution cannot be reached, the parties agree to engage in mediation before pursuing any legal action. New Zealand law governs these terms.
